The Ministry of Health has announced to file an appeal next month. The decision came following the High Court ruling last week that parents caring for disabled adult children can access financial support.
Moreover, the Solicitor General recently extended a confirmation that he will seek leave to appeal.
The High Court on Friday showed an overwhelming support to the Human Rights Tribunal ruling related to a ministry policy to pay carers only in case they were not linked to the patient was biased.
Till now ministry policy had been able to grant paid care eligibility to severely disabled adult children, however not if the caregiver was a family member.
"The ministry has been advised by Crown Law that the decision contains issues of law that have significant implications for other Bill of Rights cases and more broadly for Government decision-making", National Health Board director of national services Kelvin Moffatt was quoted as saying today.
It is claimed that the main aftermath of the decision stood largely away from the health and disability sector, he added.
Parents of disabled children, head by the Office of Human Rights Proceedings, outlined significant prejudices on the basis of their family status.
