In 2010, Dr. Susan Lim was allegedly accused of overcharging a female patient from the Brunei royal family. She was forced to have a disciplinary committee (DC) hearing, yet the committee stepped down before giving a verdict.
When Lim was faced with a second hearing, she went to the High Court to challenge Singapore Medical Council’s (SMC) decision of a second hearing. Lim stated that the DC hearing proposed by the SMC was biased and illegal, yet Justice Phillip Pillai states that Lim was unable to provide evidence of these convictions.
Justice Pillai states that she would have to prove that SMC’s decision to have a second hearing was enforced because of bias, yet she failed to do so. Lim does not have any proof to back up her convictions. Lim wanted the court to interfere with the second hearing. Justice Pillai states Dr. Lim “feebly” invited the courts to interfere.
Just Pillai states: “It would be startling for a court of law to draw inferences of actual bias other than from direct evidence”. This was something that Dr. Lim could not provide, and Justice Pillai has otherwise rejected her claims.
