The discussion over the plain packaging has again gripped momentum as it has been reported that British American Tobacco has appealed in the High Court against the Federal Government's plain packaging laws for cigarettes.
The British American Tobacco has alleged that the Federal Government is trying to procure intellectual property papers though unfair means. Although petition has been filed in the High Court, no revelation has been made as to when the trial over it will be conducted.
While, defending its move the British America Tobacco noted, "We will defend our valuable intellectual property on behalf of our shareholders. If the same type of legislation was introduced for a beer brewing company or a fast food chain, then they would be taking the Government to court and we are no different".
A similar move has also been taken by the tobacco company Philip Morris Asia. On 21st of November, the Company accused Commonwealth for stealing its brands. All the tobacco firms are at the moment are horrified because of the stern step taken by the Federal Government in minimizing the consumption of tobacco.
The Federal Government is determined to go ahead with its plain packaging scheme. Under this scheme, all the tobacco manufacturers would be required to sell their products after bringing changes on its packaging. From 2012 onwards, graphic warnings will dominate the packaging of cigarette.
Australia will be the first country to take such a stern action against the tobacco companies. A stir among the tobacco companies has already taken place. The firms are now determined to take the government to court for looting their trade right. Commenting upon the action taken by the tobacco companies, the Health Minister Nicola Roxon noted that the tobacco firms are fighting for their right and the government will fight for the innocent lives which become the victim of tobacco smoke.
