Australian Firm Wins Right to Call Itself “Nuckin Futs”A report has revealed that an Australian snack company, which was earlier being objected for its snack name Nuckin Futs, has finally got the green light to sell its products. However, they would need to ensure that they sell their snacks to only at nightclubs and pubs and should not be marketed to children.

The company has agreed to the condition of the Trade Marks Examiner, and is only selling its product at those places where children are not allowed. Initially, the examiner opposed on the name of the snack as it was similar to the four letter word starting with f.

The lawyers for the company said that the word is normally taken in Australia. So, there would not be many people who would have negative feeling while taking this snack. Though they also agreed that the name could sound distaste, it would not be a big problem for majority of people.

They further affirmed, “We submit that whilst there may be a mere sentimental objection or mere distaste to Nuckin Futs, this is not a sufficient ground for rejection of the trademark, particularly since a substantial number of people would not find the words shocking”.

The unnamed company has won the trademark case in the court, but it seems it would have to a lot of difficulties in the future. The Trade Marks Examiner has clearly ruled out that if they would find children involved in the case, then the company could be in a big problem.

The company lawyers said that it was not an easy win for them as they have to gather evidences that the four letter f-word is being used in many social events such as during sports matches and at many other events as well.
