The recently-dismissed Infinity Ward chiefs - Jason West and Vince Zampella – have filed a lawsuit against their former employer Activision, alleging the company of misdeeds; and demanding $36 million in damages, legal fees, and future royalties.
In addition, the two ex-Infinity Ward executives are also seeking a judicial settlement of their rights to creative control of the Modern Warfare brand, along with their rights over the Call of Duty brand; as per the agreement signed in 2008 – under which the contracts of both West and Zampella would have extended until October of 2011.
According to a lawsuit copy that the attorneys of the dismissed developers have forwarded to GameSpot, Activision has largely been accused of “astonishing arrogance and unbridled greed.”
Specifically speaking, West and Zampella have said that Activision launched a fake investigation into their activities at Infinity Ward with the sole aim of dismissing them; so as to escape contractual obligations, and the royalty payments that would have commenced from March 31.
With West and Zampella claiming that Activision had not clarified the reason for which they were being grilled by the investigators, the lawsuit alleges: “Activision has adopted the corporate strategy of forcing Messrs. West and Zampella to sue for their pay--in the hopes of either getting away with not having to pay them anything, or maximizing its leverage to reduce that pay.”
