On Monday it was announced by Medtronic Inc. that the patent-infringement lawsuit it filed against AGA Medical Corp. in 2007 has been settled.
Fridley-based Medtronic in the lawsuit had alleged infringement by the AGA upon the patent for its Jervis family of patents. The use of stress to restrain self-expanding medical devices made of nitinol, a shape-memory metal alloy frequently used in medical devices, including Medtronic’s transcatheter coronary heart valves is covered by this patent. The patents are to expire in 2018.
Plymouth-based AGA will make undisclosed payments to Medtronic under the terms of the settlement. This would further grant a non-exclusive license to AGA to use the Jervis patents.
Jervis patents to U. S. medical device makers has been licensed by Medtronic (NYSE: MDT) and will continue to offer licenses moving forward.
